Do You Qualify For A Massachusetts Hardship License?

  • First-time OUI offenders may apply for a hardship license three days after the disposition of the criminal case if they enroll in an alcohol education program and provide proof that not having a restricted driver’s license presents a hardship.

  • Second-time OUI offenders must wait one year, while using an ignition interlock device. If you are a second-time offender who was convicted of OUI over 10 years ago and was permitted to take the 24D first offenders program this time, there is still a requirement for the ignition interlock device during any period of hardship license.

  • Third-time OUI offenders must wait two years after the disposition of the criminal case and agree to installation of an ignition interlock device before they may apply for a hardship license. The driver must then wait an additional two years before applying to have his or her driver’s license reinstated.

  • Fourth-time OUI offenders are eligible for a hardship license after five years, if an ignition interlock device has been in service for two years. Eight years after the OUI disposition, the driver may apply for reinstatement of the driver’s license.

  • Fifth-time OUI offenders are not eligible for a hardship license.
