Changes in the OUI Law
Recent changes in the OUI statute have also strengthened the prosecutor's arsenal in prosecuting people charged with driving under the influence. Under the old OUI law, a blood alcohol concentration (BAC) of .08 percent or greater was merely one piece of evidence that the Commonwealth could use to prove that the accused was impaired while driving. Under revisions to the Massachusetts OUI statute (also called Melanie's Law), enacted in November 2005, the Commonwealth may now prosecute under either of two theories:
1. The accused was driving while impaired by alcohol or drugs.
2. The accused's blood alcohol level was .08 percent or greater.
Proof beyond a reasonable doubt of either of these theories will get you a drunk driving conviction in a Massachusetts court.
